Ciccu Mukhopadhaya, specialises in international and domestic
arbitration. He has over 35 years of
experience in dispute resolution and was designated as a Senior Advocate (equivalent to
Silk) in the
year 2011.
He has acted as a counsel in over 225 arbitration cases under ad hoc and
institutional arrangements
(ICC, LCIA, SIAC and UNCITRAL). Additionally, he has acted as a counsel in arbitrations
under
various trade bodies including GAFTA, FOSFA and Chamber of Commerce arbitrations. He
frequently
sits as arbitrator (party-appointed and chair) in international and domestic commercial
arbitrations. He
has also been a mediator and assisted as counsel in mediations both domestic and
international.
Ciccu Mukhopadhaya, regularly appears before the Supreme Court of India and various
High Courts in
constitutional and commercial matters. Additionally, he has assisted various courts (Supreme
Court and
High Courts) in ancillary arbitration proceedings such as the appointment of arbitrators,
interim measure
proceedings, post-award challenges and enforcement proceedings, both for domestic and
foreign
awards. He has appeared before National Company Law Tribunal, National Consumer Disputes
Redressal Commission and Appellate Tribunal for Electricity.
Experience in
arbitration related to diverse subject matters such as civil and structural construction
projects (including transmission towers, power evacuation facilities, roads, ports, airports
and railway
lines), oil & gas construction contracts, power plant construction contracts and
infrastructure projects
(road, ports and airports). Further, he has experience in arbitration relating to technology
transfer
agreements, production sharing contracts, company-shareholder disputes, joint venture
agreements
disputes, collaboration agreements disputes, private public partnership agreements,
investment disputes
(including FDI related issues), trade and shipping disputes, e-governance projects and
intellectual
property disputes.
In addition to the dispute practice, he has extensive experience in advisory and
corporate transactional
work including drafting commercial contracts for the transfer of technology, foreign
investment supply
agreements, distributorship and agency agreements, turnkey contracts for setting up power
plants (EPC
Contracts), refurbishment contracts for power plants, operation and maintenance contracts,
power
purchase agreements, banking & finance including contracts for financial assistance
concerning
infrastructural, BOT & BOLT Contracts, Software Licensing Agreements, Shareholders
Agreements,
Joint Venture Agreements, Collaboration Agreements, etc.
He is currently the President of the ICC’s Indian Commission on Arbitration. He was
also the Vice
President, the ICC Court of Arbitration, Paris
