Ms. Indu Malhotra is a former Judge of the Supreme Court of India. She is now practising as a full-time Arbitrator in both international and domestic arbitrations. Prior to her elevation, she was practising as a Senior Counsel in the Supreme Court of India, and appeared before various High Courts. In 2007, she was designated as Senior Counsel by the Supreme Court. In 2018, she was the first woman to be directly elevated from the Bar as a Judge of the Supreme Court of India.

Justice Indu Malhotra has specialized in the field of arbitration. Prior to her elevation, she appeared in various domestic and international commercial arbitrations. She is a Fellow of the Chartered Institute of Arbitrators, London. She is empanelled with various arbitral institutions, such as the Mumbai Centre for International Arbitration (MCIA), Singapore International Arbitration Centre (SIAC), Indian Council of Arbitration (ICA), Delhi International Arbitration Centre (DIAC), and the Associated Chambers of Commerce and Industry of India (ASSOCHAM).

She has contributed significantly to arbitration jurisprudence, both as a Counsel and as a Judge when she has authored significant judgments in Arbitration while she was on the bench.

In 2005, she was nominated by the Chief Justice of India in the category of ‘eminent persons’ as a member of the General Council of the Gujarat National Law University established under the Gujarat National Law University Act.

The Ministry of Law and Justice, Government of India constituted a High Level Committee in 2017 to review the working of existing arbitration institutions, and to make recommendations for institutionalization of arbitration in India, and suggest legislative amendments to the Arbitration and Conciliation Act, 1996. Justice Malhotra was appointed as a member of this Committee, which submitted a Report to the Ministry of Law & Justice. The 2019 Amendments to the Indian Arbitration & Conciliation Act, 1996 are mostly based on the recommendations of this Committee.

She has been a Member of the Academic Council of the National Law School of India University, Bangalore.

She was on the Governing Board of Miranda House College from 2017-18 to 2019-2020.

She has also been a Member of the Indian Law Institute.

Justice Malhotra has published the 4th Edition of the Commentary on the Law of Arbitration in India in March 2020, published by Wolters Kluwer. The Commentary has been cited by the Supreme Court and High Courts in various Judgments.
